Supreme Court approves separate quota for marginalised among SC/ST


The landmark judgement was delivered by a bench headed by Chief Justice of India DY Chandrachud with a majority of 6:1, with Justice Bela Trivedi dissenting.

A seven-judge Constitution Bench of the Supreme Court today approved sub-classification within the Scheduled Caste and Scheduled Tribe categories to provide jobs and education to the more marginalised among the lower strata of the population.

The landmark judgement was delivered by a bench headed by Chief Justice of India DY Chandrachud with a majority of 6:1, with Justice Bela Trivedi dissenting. Six separate judgements were written. The verdict overturns the verdict of a five-judge Constitution Bench in the 2004 case of EV Chinnaiah v. State of Andhra Pradesh. The other judges on the panel were Justice BR Gavai, Justice Vikram Nath, Justice Pankaj Mittal, Justice Manoj Misra and Justice Satish Chandra Mishra.


During the hearing, the Central government told the Court that it was in favour of sub-classification into Scheduled Castes and Scheduled Tribes. The Chief Justice noted that there is a difference between "back classification" and "sub-category" and was of the view that to ensure benefits reach the more disadvantaged, states may need to sub-classify communities into reserved categories.


There are six views. Mine are those of Justice Manoj Misra and myself. Our majority, setting aside the judgment in EV Chinnaiah, are of the opinion that sub-classification is permissible. Justice Bela Trivedi disagreed," he said this morning.


"Members of the SC/ST category are often unable to climb the career ladder as they face systematic discrimination. Article 14 recognises sub-categorisation of castes," the Chief Justice said, adding, "historical evidence shows that the downtrodden classes were not homogenous classes." BR Ambedkar had said in 1949 that political democracy without social democracy is meaningless.


"The hardships and backwardness suffered by a section of the Scheduled Castes vary from caste to caste. The EV Chinnaiah case was a miscarriage of justice. It is argued that political parties can give reservations to sub-castes to gain political advantage, but I do not agree with this. "The ultimate goal is to achieve true equality," he said.

As Wayanad was devastated by landslides, resulting in the loss of several lives, Union Home Minister Amit Shah on Wednesday accused the Kerala government in Parliament of ignoring his July 23 warning of a possible natural disaster in the region and ignoring excess rains.


He, however, said the Union government would work resolutely with the Kerala government in dealing with the aftermath of the Wayanad landslide. Talking about the situation following the devastating landslides in Wayanad Shah, he said the Kerala government was not alerted by the arrival of nine battalions of the National Disaster Response Force (NDRF) either, adding that several lives could have been saved had they come and acted in a timely manner.

India, China hold diplomatic talks, agree to maintain peace at LAC
The Working Mechanism for Consultation and Coordination on Border Issues between India and China met for the 16th time since the standoff at the LAC began in May 2020 in New Delhi.
India and China on Wednesday agreed to maintain peace and tranquility at the Line of Actual Control (LAC) during separate diplomatic talks despite no signs of a breakthrough towards disengagement at friction points in the Ladakh region.
The Working Mechanism for Consultation and Coordination on India-China border issues (WMCC) met for the 16th time in New Delhi since the standoff at the LAC began in May 2020. The panel last met in Beijing on March 28 and Wednesday's meeting followed two meetings this month between External Affairs Minister S Jaishankar and his Chinese counterpart Wang Yi.
After the talks, the two sides agreed to "jointly maintain peace and tranquility in the border areas in accordance with relevant bilateral agreements, protocols and understandings between the two governments", a foreign ministry statement said.

Following discussions between the two foreign ministers at recent meetings in Astana and Vientiane, the two sides reviewed the current status on the LAC "with a view to early resolution of outstanding issues". The statement further mentioned India's position that overall relations with China cannot be normalised without addressing the disputed border situation and said, "Restoration of peace and tranquility and respect for the LAC are essential foundations for the restoration of normalcy in bilateral relations."

The statement said the discussions were "in-depth, constructive and forward-looking" but did not provide details. The two sides also agreed to maintain momentum through established diplomatic and military channels.

This was also the 30th meeting of the WMCC since its inception in 2012. The Indian delegation was led by Goorangalal Das, Additional Secretary (East Asia) in the Ministry of External Affairs, while the Chinese side was headed by Hong Liang, Secretary-General. The meeting was led by the Border and Oceanic Affairs Department of the Ministry of Foreign Affairs of China.

Hamas Chief Ismail Haniyeh Killed In Iran's Capital, Hamas confirms

 


The Palestinian group said in a statement today that Hamas leader Ismail Haniyeh and one of his bodyguards were killed in an attack on their residence in Iran.

Hamas said Ismail Haniyeh was killed Tuesday morning in a "traitorous Zionist attack on his residence in Tehran." The group said an investigation was underway to determine the details of the attack.

Haniyeh had been in the Iranian capital to attend the swearing-in ceremony of Iranian President Massoud Pezeshkian.

"Our brother and mentor, Mujahid Ismail Haniyeh, leader of the movement, was killed in a Zionist attack on our headquarters in Tehran after attending the inauguration of the new (Iranian) president," the statement said.

The Iranian Revolutionary Guard also confirmed Haniya's death, saying his residence in Tehran was "attacked" and that he was killed along with his bodyguard.

Hamas called Haniya's killing a "serious escalation" and blamed Israel.

"This assassination of the Haniya brothers by Israeli occupation forces is a serious escalation aimed at breaking Hamas' will," said Sami Abu Zuhri, a senior Hamas official.

The Israeli military did not immediately respond to Haniya's killing.

Israel had vowed to kill Ismail Haniyeh and destroy the Hamas organization after an attack on October 7 killed 1,195 people, mostly civilians.

According to the Ministry of Health, Israeli retaliatory operations in the Gaza Strip have killed at least 39,400 people in Hamas-controlled areas.

Haniyeh was elected head of Hamas' political office in 2017, replacing Khalid Meshaal. Considered a pragmatist, Haniyeh lived in exile, dividing his time between Turkey and Qatar.

During the war, he visited Iran and Turkey on diplomatic missions and met the presidents of Turkey and Iran.

Haniyeh is said to maintain good relations with leaders of various Palestinian factions, including Hamas' rivals.

He joined Hamas in 1987 when the militant group was founded during the outbreak of the first Palestinian intifada (uprising) against Israeli occupation, which lasted until 1993.
