Witness credibility questioned in Donald Trump's hush money case as jury deliberates without needing his testimony.

Former US President Donald Trump just sat back and listened to the New York hush money case judge as he began instructing the jury on what could potentially be detrimental to his defence.

Judge Juan Merchan, directing the jury, said that while the prosecution is required to prove the case against Trump, it cannot be legally argued that Trump must testify for the jury to determine whether he is guilty or not beyond a “reasonable doubt.”

Merchan clarified that the jury does not need to agree on what specific crime Trump allegedly attempted to conceal by falsifying documents.

While listening to instructions from within the courtroom, Ukraine-born George Washington University law professor Jonathan Turley remarked, “Merchan just delivered the coup de grace instruction.”

Merchan said that the jurors “can disagree on what the crime was among the three choices” suggested by the prosecutors, Turley stated these as violation of tax laws, other business records and the Federal Election Campaign Act. “Thus, this means that they could split 4-4-4 and he will still treat them as unanimous,” he further said.

Michael Cohen's testimony needs confirmation, judge tells jury.

Marchan noted that the jury would need to reach a unanimous decision on each charge of falsifying business records, but legal scholars in the room agreed that there didn't seem to be much room for a split verdict or for Trump to be found guilty or convicted. Not guilty.

"It's either 34 guilty verdicts, 34 not guilty verdicts, or the jury doesn't agree," former federal prosecutor Trey Gowdy said.

"I can't imagine a verdict that would convict on some counts and acquit on others." Marchan defined the concept of reasonable doubt for the jury to use in the trial, explaining: "It is knowable without a degree of uncertainty," but "not sufficient to conclude that the defendant is probably guilty."

The judge also addressed witnesses called by the prosecution in the case, including Michael Cohen, the former president and attorney accused of falsifying business records and misappropriating $130,000 meant for payments to porn star Stormy Daniels.

Seoul's Joint Chiefs of Staff said that "unidentified objects believed to be North Korean propaganda leaflets have been identified in the Gyeonggi-Gangwon border area and the military is taking action".

"Citizens should refrain from outdoor activities, do not come into contact with any unknown objects, and report them to the nearest military base or police," it said in a statement sent to AFP.

It said that the North's actions "clearly violate international laws and seriously threaten the safety of our people," saying some of the balloons had contained suspected trash, which the military was checking.

Major Radhika Sen, who served with the United Nations peacekeeping mission in Democratic Republic of Congo, will be honoured with the prestigious 2023 Military Gender Advocate of the Year Award. The UN award is an acknowledgement of her remarkable efforts and advocacy for the rights of women and girls during her tenure as a peacekeeper.

The award also recognises her efforts in line with the 2000 Security Council resolution aimed at protecting women and girls from conflict-related sexual violence. The ceremony will take place on the International Day of UN Peacekeepers. 

Who is Radhika Sen?

1. Born in Himachal Pradesh, Radhika Sen initially pursued a career in biotechnology engineering. She was in the middle of her master's degree at the Indian Institute of Technology Bombay when she decided to join the Indian Army.

2. Ms Sen was assigned to the MONUSCO (United Nations Organization Stabilization Mission in the Democratic Republic of the Congo) in 2023. She served as the Engagement Platoon Commander with the Indian Rapid Deployment Battalion till April 2024.

3. Radhika Sen is the second Indian peacekeeper to receive the Military Gender Advocate of the Year Award. Before Ms Sen, Major Suman Gawani was recognised for her service with the UN Mission in South Sudan. She was honoured in 2019.

4. Among the 6,063 Indian personnel deployed in UN peacekeeping operations, Ms Sen served alongside 1,954 individuals within MONUSCO, of which 32 were women. Her work created safe spaces for women to unite and discuss issues.

5. Ms Sen led peacekeeping efforts in the eastern Democratic Republic of the Congo (DRC) with a focus on gender equality, according to the UN. She organised programs like English classes for kids and health and vocational training for adults. Ms Sen also established Community Alert Networks, aiding conflict-affected communities in North Kivu.
