Application filed in SC supporting amendments to Waqf Act

 

The Hindu Sena on Wednesday filed an intervention application before the Supreme Court supporting the Waqf (Amendment) Act, 2025.

The move came in the backdrop when multiple petitions have been filed before the apex court challenging the constitutional validity of the amendments introduced in the Waqf Act, 1995.

The latest application filed by the National President of Hindu Sena said that the amendments are in consonance with the scheme of Constitution of India.

“There is no violation of any right of any member of the Muslim Community. Rather the unamended provision of Waqf Act, 1995 caused serious prejudice to the right and interest of the non-Muslim members of society as in view of Section 3 read with Section 40 of Waqf Act, 1995, the properties of non-Muslim were taken over by Waqf board,” it said.

The application added that in view of the amendments, the non-Muslim will get justice whose properties have been taken over of claimed to be waqf properties.

It contended that the Parliament has amended the draconian provisions by the Waqf (Amendment) Act, 2024 with no infirmity or illegality in the amendments.

Recently, the Union government has filed a caveat in the Supreme Court in response to the petitions seeking a stay on the implementation of the Waqf (Amendment) Act, 2025.

A caveat serves as a notice submitted to a court by a party to a litigation who wishes to be heard in case any stay order is likely to be issued on the opponent’s plea.  The concept of ‘Waqf’, rooted in Islamic laws and traditions, refers to an endowment made by a Muslim for charitable or religious purposes, such as mosques, schools, hospitals, or other public institutions.

Tahawwur Rana, a Pakistani-origin citizen of Canada, arrived in Delhi on Thursday following an extended legal dispute in the US, where he contested extradition based on health and legal issues. His return to India represents a significant development in the country’s effort to seek justice for the attacks of 2008. 

Upon his landing, the National Investigation Agency (NIA) officially detained Rana and obtained an 18-day custody order from a special court in Delhi. Authorities claim he played a vital role in assisting with the 26/11 conspiracy, particularly in aiding co-defendant David Coleman Headley in carrying out reconnaissance of possible targets in Mumbai.

Rana has already been found guilty in the US due to his association with Lashkar-e-Taiba, the terrorist organization that orchestrated and carried out the assaults from Pakistan. A court in the US found him guilty of assisting in the planning of an attack on a Danish newspaper that published cartoons of Prophet Muhammad, but he was exonerated concerning the charges related to the 26/11 attacks in Mumbai. Nevertheless, his connections with Headley became public knowledge during the trial in Chicago.

During his testimony, Headley addressed Ujjwal Nikam's inquiries regarding the planning and execution of the 26/11 attacks. His statements clarified Tahawwur Rana's role, leaving no ambiguity.

After Rana's conviction in 2009, the Federal Bureau of Investigation of the US stated that he confessed to being aware of Lashkar's status as a terrorist group. "In an October 2009 statement made post-arrest, Rana acknowledged understanding that Lashkar was a terrorist organization, and that Headley participated in training camps operated by Lashkar in Pakistan. Headley testified to attending these camps five different times between 2002 and 2005. In late 2005, he received directives from Lashkar members to visit India for reconnaissance, which he carried out five times leading up to the Mumbai attacks three years later, which resulted in over 160 fatalities and numerous injuries," the statement noted.

What prompted Trump to pause the tariffs? 

For several days, other Republicans and business leaders urged the US President to halt the tariffs due to concerns about an imminent trade war, which could lead to a severe market collapse, alongside fears of a potential global recession. Nevertheless, he remained firm, stating, "My policies will never change." 

While addressing reporters following the tariff pause announcement, it became evident that the choice appeared to be impulsive instead of a well-devised plan. 

US Stock Market Reaction 

Wall Street’s stocks soared on Wednesday after Trump’s unexpected decision to pause numerous new tariffs, boosting an equity market that had suffered from days of declines due to increasing recession fears. Almost immediately after the announcement, the Dow index jumped by approximately 2,500 points, moving towards a nearly eight percent increase for the day. The tech-heavy Nasdaq climbed by 12.2 percent, marking its best performance in 24 years, while the S&P 500 rose by 6.0 percent to reach 5,281.44 points. 

Oil prices surged by over four percent, and the dollar also appreciated. 

Impact on India 

Since Trump implemented a 26 percent customized reciprocal tariff on imports from India, the Indian stock market has experienced a significant downturn. Nevertheless, with the 90-day pause, stocks may receive some relief, allowing New Delhi additional time to negotiate a deal with the US. 

“India and the United States have a robust partnership regarding trade relations, economic relations, investment relations, and commercial relations. We hope to see these connections continue to grow and strengthen. Concerning trade matters, we are negotiating a bilateral trade agreement, and we hope to resolve these issues and finalize this specific agreement promptly,” he stated.
