Bilkis Bano case: Convicts move Supreme Court seeking extension of time to surrender, cites ill health

Govindhbhai Nai, one of the convicts in the Bilkispano crime case, approached the Supreme Court seeking to give four weeks time to the prison authorities concerned to think about the trust issue.

On January 8, the Supreme Court ordered Nye and ten other detainees to surrender to police within two weeks.

In his application for an extension, Nai cited health and family responsibilities as reasons for requesting an extension.

As requested, Nye's father went to bed and stayed there.

He added that he recently had an angiography and had not yet undergone another surgery to treat "hemorrhoids".

The Supreme Court is hearing 11 convicts (accused) convicted of raping Bilkis Bano and killing her family during the 2002 Gujarat riots.

Last year, on the eve of Independence Day, that is, on August 14, 2023, these inmates were released early from prison without serving their full sentences.

The Government of Gujarat allowed their conversion after the Supreme Court in May 2022 ruled that the application for conversion should be considered valid as per the law of the state where the crime was committed (Gujarat in this case). the place where the hearing will be held.

According to this decision, although the hearing of the case was held in Maharashtra, the Gujarat government exercised its right to commute the sentence and release the convicts.

The Gujarat government's decision was challenged in the Supreme Court by several petitioners, including Bano.

The Supreme Court of Justice BV Nagarathna and Ujjal Bhuyan canceled the benefits granted to them by the Gujarat government on January 8. It concluded that the Gujarat government had no authority to implement the sentence commutation law for the 11 convicts.

So within two weeks he ordered all eleven thrones.Update: Two more convicts applied to the Supreme Court to postpone the delivery.

Character Ramesh Ruabhai Chandana sought an extension of six weeks, claiming that she had to get her son married and fulfill her duty.

Actor Mitesh Chimanlal Bhat also requested a six-week extension, saying that his winter crops are ready for harvest and he wants to complete the entire process and postpone it later.

Update: The total number of applications is now five; Another prisoner, Pradeep Ramanlal Modhiya, wants four more weeks to surrender as he recently underwent lung surgery, which will take time for him to recover.

Another application was made by detainee Bipinchand Kanaiyalal, seeking an extension of six weeks to surrender due to partial disability due to leg surgery.

Update: The sixth petition has now been filed by convicts Radheshyam Bhagwan Das and Rajubhai Babulal Soni. Both men wanted to leave the country for weeks, citing the need to provide financial support to their families.

Radheshyam is a criminal who is believed to have deceived the Supreme Court by concealing the facts and was eventually granted a reduction in his sentence.
