The High Court on April 9 rejected Delhi Chief Minister Arvind Kejriwal's plea against his arrest in a liquor law case, sources in the watchdog said. The investigation revealed his involvement in the use of proceeds of crime.
HC said, "Documents collected by the Education Ministry revealed that Kejriwal was involved in formulation of excise law and use of proceeds of crime."
Following the HC verdict, AAP said it has decided to move the Supreme Court on April 10.
Meanwhile, the HC upheld Kejriwal's arrest on the grounds that it was not illegal. The court also noted that it had no objection to Kejriwal being sent to judicial custody. The Delhi chief minister said his arrest was a well-planned attempt to embarrass him and damage the Lok Sabha polls.
A bench of Justice Swarana Kanta Sharma said that this court was of the view that the petitioner was arrested for money laundering and his arrest and defense should be examined by the court from the point of view of law, irrespective of the election.
The ED case also revealed his involvement in his personal capacity as an AAP representative. Excusing those who accept is not at the discretion of the Ministry of National Education, but a judicial decision. "If you denigrate the pardon... you are insulting the judge," the court said.
The court also said that it does not matter who purchased the voter's license or who bought the ticket for the upcoming elections. Elections.
HC said, "Political decisions cannot be taken in court. The matter before the court is not a dispute between the central government and Kejriwal. This is the case of Kejriwal and ED." “The court is only interested in morality, not political morality.”
Even though Kejriwal said the case against him was a "political conspiracy", the investigating agency is still trying to arrest the Aam Aadmi Party leader.
AAP's national conference questioned the "opportunity" of the union's arrest and said it violated key documents of the constitution, including free, fair elections and fair and equal conditions.
