Jharkhand High Court dismisses Rahul Gandhi plea against defamation proceedings for remarks about Amit Shah

 


The Jharkhand High Court recently rejected Congress leader Rahul Gandhi's plea to compel proceedings in the harassment case filed against him for telephoning the Union Minister and accusing former or former Bharatiya Janata Party leader Amit Shah of murder.


Justice Ambuj Nath noted that Gandhi had said that the BJP leaders were liars and that the BJP workers would accept a person accused of being a murderer as their leader.

"On the face of it this statement is saying that Mr Rahul Gandhi is accusing the BJP leaders of drinking alcohol and involving liars. This imputation is prima facie defamatory in nature," the Court said while refusing Gandhi's plea.


The case arose after BJP leader Navin Jha filed a complaint against Gandhi, alleging that Gandhi delivered a speech on March 18, 2018 criticizing the BJP and accusing Shah of being involved in murder.


Initially, a magistrate court at Ranchi dismissed Jha's complaint prompting him to file a revision petition before the Judicial Commissioner in Ranchi.


The judicial commissioner in Ranchi on September 15, 2018 overturned the order that dismissed the complaint petition and sent it back to the magistrate court.


The judicial commissioner directed the magistrate to review the evidence on record again and issue a fresh order regarding the determination of prima facie material to proceed with the matter.


The judge then issued a fresh order on November 28, 2018, concluding that there was sufficient evidence to file a case against Gandhi for defamation punishable under Section 500 of the Indian Penal Code (IPC). Therefore, the judge issued a press release summoning Gandhi to the court.


Gandhi then approached the Supreme Court challenging Justice Ranchi's order dated September 15, 2018.

The Supreme Court held that the gist of the speech was that Gandhi said that the BJP leadership was eager for power and contained liars.

“This means that the BJP members will accept this person as their leader. These allegations are defamatory in nature. ” added the court.

The court also referred to the 2nd Explanation of Article 499 of the TMK, which states that an allegation made against a company, organization or organization falls within the scope of the crime of insult.

Escalation is not in anyone’s interest

 


The death of a young farmer in a clash with Haryana police on Wednesday escalated more than a week of conflict between farmers. According to unconfirmed reports, farmer Shubhkaran Singh was killed by tear gas.

Thousands of protesting farmers were stopped by Haryana police while they were on their way to Delhi for the 'Dilli Chalo' march and were camping in Khanauri and Shambhu. They fought back with tear gas, rubber bullets, water cannons, threats and other restrictions.

Farmers suspended their strike for two days following the death of young farmers. There was support for both sides to take steps to ensure farmers' demands are not compromised, including at least legal recognition of the purchase of goods at a reasonable price. Four meetings were held between the government and farmers but no success was achieved. Farmers did not accept the government's proposal to introduce MSP for cash crops and purchase pulses (tur, urad and Masoor), maize and cotton crops at MSP for five years.

Parkland shooting survivor David Hogg, displeased with Donald Trump's announcement of a new sneaker line, bought a new website dedicated to the former US president's new shoes and turned it into an anti-crisis website where visitors can give advice to lawmakers. Trump announced the line at the Sneaker Conference in Philadelphia following the decision at the public hearing in New York. At this hearing, he had to pay $355 million for one year's inflation of his assets in exchange for inflation.

"Just purchased shoptrumpsneakers.com," Hogg wrote to X on Friday. Hogg is president of Leaders We Deserve, a company dedicated to recruiting young candidates.

“I posted the page for you to contact your member of Congress. The difference is that the caller is a victim of gun violence and their voice is recreated using artificial intelligence to advocate for gun safety.

He even criticized Trump, saying he was "trying to get young people to vote by selling sneakers."

Anti-gun violence campaigner Hogg said after the site was launched: "I'm not going to lie, I'm really happy about it. Thank you to my tech-savvy friends for their help."

The name is linked to "gettrumpsneakers.com," which sells sneakers priced between $199 and $399 to help Trump raise funds for the former president's impending impeachment.

"The lost voice against gun violence calls for change," Hogg's website theshotline.org wrote.

"Guns are falling silent, and thousands of innocent people are being killed every year. Using smart tools, we are recreating the voices of these people being shot and killed, so they can call on our representatives in hopes of changing the course of our nation's gun laws."

The site has received 83,812 calls since its establishment. Visitors to the site can choose from 6 different voices of gun victims. Once they enter their postcode, they can choose which file to send to their MP.

Sarwan Singh Pandher said on Tuesday morning that the government has made its intentions clear that it will not let them enter Delhi.

Hours after farmers leading the 'Delhi Chalo' agitation rejected the Centre's proposal to procure pulses, maize and cotton at MSP, farmer leader Sarwan Singh Pandher has warned the BJP-led government that it will be responsible for "whatever happens now".

After the talks with the government failed, the protesting farmers have announced they will continue their march to Delhi on Wednesday, February 21.

Pandher said on Tuesday morning that the government has made its intentions clear that it will not let them enter Delhi.

"The intention of the government was very clear that they would not let us enter Delhi at any cost...If you don't want to find a solution through discussion with farmers then we should be allowed to march towards Delhi," he told ANI.

Referring to the unprecedented steps taken by the police to stop the march, Pandel said that the situation in Haryana is comparable to Kashmir.

"When we went to Delhi, there were bombings... Tractors were also shot at... Haryana IGP told farmers that they did not use tear gas... We demand that those who used tears should be punished. They were punished... Now there are wrong demands... Haryana' "The situation is like Kashmir. We will march to Delhi on February 21...The government has instructed us to give up our old demands...Government Will Take It Now, we take responsibility no matter what," he added.

Defamation case: Rahul Gandhi briefly taken into custody, granted bail ..

 


Congress leader Rahul Gandhi was on Tuesday acquitted by the Sultanpur court in the 2018 case filed by BJP leader Vijay Mishra regarding his comments against Chief Minister Amit Shah's bail. The court detained him for 30 to 45 minutes, his lawyer said.

Rahul's lawyer said about Santosh Pandey: "He (Rahul Gandhi) was produced in the court today. He was stopped and the court kept him in custody for 30 to 45 minutes. After that the bail application was submitted and accepted (by the court)... The further date has not been given yet. His lawyer said that he is innocent and he has not made any defamatory statement...”.

Pandey further said that Rahul Gandhi could be given a maximum punishment of 2 years if sufficient evidence was found against him. Rahul was granted bail by Judge Yogesh Yadav after filling bail bonds.

The defamation case was filed against Congress leader Rahul Gandhi for allegedly making objectionable comments against Shah at a press conference in Bengaluru on May 8 that year. Amit Shah was the president of the Bharatiya Janata Party when Gandhi said these words. Rahul Gandhi attacked the Bharatiya Janata Party, saying the party claimed to believe in justice and cleanliness but the party president was a "suspect" in the murder case.
