The Supreme Court on Monday refused to interfere in Delhi Chief Minister Arvind Kejriwal's bail issue and said it would await orders from the Delhi High Court. The Aam Aadmi Party national leader had sought the Supreme Court to quash the Delhi High Court's bail stay in his excise scam case. His lawyers had sought an urgent hearing this morning. A vacation bench comprising Justices Manoj Misra and SVN Bhati had filed Kejriwal's application on June 26. Senior advocate Abhishek Singhvi, appearing for Kejriwal, sought cancellation of the interim bail.


Additional Solicitor General SV Raju, representing the Enforcement Directorate, told the Supreme Court that the Supreme Court's order is expected to be passed within a day or two. The Supreme Court agreed that if it issues an order now, it will take precedence over any decision on the matter.

The Supreme Court said, "This is not a lower court. It is the Supreme Court."

Kejriwal was arrested by the ED on March 21 in connection with a money laundering case linked to alleged irregularities in the now-repealed Delhi Excise Policy 2021-22.

Earlier, on June 20, a Rouse Avenue court had granted regular bail to Kejriwal despite objections from the Enforcement Directorate (ED). However, ED challenged the decision in the Delhi High Court on June 21, alleging that the agency was granted bail without a fair hearing. Following ED's appeal, the Delhi High Court stayed the trial court's order and suspended Kejriwal's bail till a final decision. The Supreme Court's interim stay effectively stays the trial court's decision to grant Kejriwal bail.


While staying the trial court's order for the time being, the Delhi High Court said, "The implementation of the impugned orders remains on hold till promulgated."


Earlier, the Supreme Court had granted interim bail to the Delhi Chief Minister on May 10 to allow him to campaign during the Lok Sabha elections and asked him to appear before it on June 2. He has been asked not to visit the Chief Minister's Office or Secretariat in Delhi.
