On Thursday, turmoil erupted outside the Parliament after the Bharatiya Janata Party (BJP) announced its intention to lodge a police report against Opposition Leader Rahul Gandhi for allegedly pushing BJP MP Pratap Chandra Sarangi, who is said to have suffered minor injuries. Conversely, Gandhi claimed that it was Sarangi who shoved him as he attempted to enter the Parliament.
Nevertheless, regarding the possibility of a police complaint against an MP rooted in events that transpired on Parliament grounds, what do the regulations stipulate?
Per the established guidelines, law enforcement may initiate an investigation if sanctioned by the Lok Sabha Speaker. The Leader of the Opposition does not possess unique privileges in this context. According to the protocols, BJP MP Sarangi has the right to assert that his privileges have been compromised. Yet, in the absence of video documentation, it will boil down to Sarangi's word against Gandhi's, potentially leaving the situation unresolved due to lack of substantiation.
Former Lok Sabha General Secretary PDT Achary remarked, “The crucial factor will be video documentation. Without this, it could devolve into a matter of one MP’s statement versus that of another, making it challenging to establish proof."
