Swati Maliwal has opposed the bail request of Arvind Kejriwal's long-time aide Bibhav Kumar in the assault case


Aam Aadmi Party (AAP) MP Swati Maliwal, whose allegations of assault at Chief Minister Arvind Kejriwal's residence have raised a political storm, told a Delhi court today that a bail relief for Mr Kejriwal's long-term aide and main accused Bibhav Kumar would put her and her family in danger.

Ms Maliwal made the remarks during a hearing on a bail petition by Bibhav Kumar. The counsel for Bibhav Kumar has questioned the Delhi Police's investigation into the case and said it is the AAP MP who should be probed for trespassing into the Chief Minister's residence.


A Rajya Sabha member and former chief of Delhi Commission for Women, Ms Maliwal has alleged that Bibhav Kumar assaulted her at the Chief Minister's residence on May 13. The AAP, which earlier said Mr Kejriwal aide's "misbehaved" with Ms Maliwal and will face action, later alleged she was a part of a BJP conspiracy against Mr Kejriwal. Vibhav Kumar's lawyer said he had filed a trespass complaint against Maliwal. She said, ``He directly entered the prime minister's office. This is considered trespassing. This is the prime minister's house, but is it okay for someone like this to come?'' She was told to wait outside, but she assaulted the prime minister and I have crossed the area.” As a representative, you have the authority to do anything. This is trespassing and the FIR is against us. What kind of investigation is this? She kept asking the guards whether they had spoken to the head guard Vibhav Kumar. A security guard then entered and she was respectfully escorted out. She left the place as usual. There was no hesitation,” the lawyer said.


Vibhav Kumar's lawyer also questioned the delay in filing a police complaint against Maliwal. “She did not press charges that day. She did it three days later. She was her DCW boss and knew her rights. If her rights were violated, she should have reported it immediately. ``Why is there a three-day delay?'' the lawyer said.


Mr. Vibhav Kumar's lawyer also asked what was the motive behind the alleged crime. "Look at the place where the incident took place, there are a lot of people there. The protocol officers are there, the security guards are also there and everyone knows that Swati Maliwal called Vibhav Kumar."


Counsel also questioned the police's decision to add an IPC section regarding intention to remove women's clothes. "She had no intention of stripping her. Her only purpose was to prevent them from entering the CM's residence. The allegations made indicate that there was an intention to strip her. Is not." All that is visible is that her shirt was torn during the scuffle. It was a fortuitous situation. ”


The entire FIR was “an afterthought”, said Vibhav Kumar's lawyer. ``I'm just asking for bail, I'm not asking for acquittal or dismissal, I'm asking for bail.'' Everything was pre-planned to fit the story. ”

At one point during the hearing, Ms. Maliwal began crying.

Delhi Police's lawyer opposed Vibhav Kumar's bail application and said there was no need for intentionality in the case. "You hit a woman, alone, without any provocation. She was dragged. You hit her so hard that her buttons came off... There's no need for intent here, but what you're doing is humility."

Delhi Police Lawyer Reacts to Vibhav Kumar's Allegation, Ms. Maliwal Appears Before the Chief Minister. A minister's official residence aimed at lowering the image. "She is a sitting MP. "I was beaten up badly," Maliwal told the court, adding that AAP leaders were alleging that I was a representative of the Bharatiya Janata Party. AAP has a huge social media troll machine. If this man appeared in public, it would be a major death threat to me and my family.'' They have a big machine of trolls and all party leaders have been warned not to go against me. He (Vibhav Kumar) is no ordinary man and has facilities that even a minister does not get. If he were to go public, my life and that of my family would be in great danger. ”
