SC demands answers from EC on contradictory, delayed demands in referendum documents: 'Why is it difficult to put this on the website?' Lawyers who sued
Election Commission argued that the real voter data provided by the voter application is updated instantly. “Therefore, any discrepancy between the application form and the Form 17C document is not material,” he said.
The Supreme Court asked the Election Commission to respond within a week to the petition regarding differences in vote percentages of the first two phases of the Lok Sabha elections. The court will hear the case before the sixth round of voting on May 24. Chief Justice of India DY Chandrachud and Justices JB Pardiwala and Manoj Misra asked ECI lawyer Amit Sharma: "What is the difficulty in publishing [vote details or Form 17]? Website as per Bar and Bench?"
ECI's lawyer replied: "It will take time. We need to collect a lot of information." This cannot be done overnight.
EC asked: “Shall the returning officer of each polling station submit Form 17C to the returning officer and the absentee on the same day?” Ok. It was already the second day. Why don't you install it now? Live Law, through the CJI's lawyer, stated that the returning officer should examine all the documents to avoid any contradictions and said, "We will give you the time you deserve." The survey data that is released immediately is incredible because it is updated instantly. “Therefore, any discrepancy between the information requested and the Form 17C information is not material,” he said.
Meanwhile, the plaintiff's lawyer said that there were concerns about the increase in the final vote percentage announced by the ECI. The petitioner's lawyer said, "People are very angry. Because they think the EVM has changed. Suddenly, there was a 6% increase."
According to ANI, Justice Promotion NGO, in its response, said that the information released by the ECI in the April 30 announcement was compared to the information released by the ECI (first level voters - 66.14%, second level voters - 66.71%). With the first data on April 19 and April 26, the data of the first phase increased by approximately 6%, while the data of the second phase increased by approximately 5.75%.
