The court rejected a petition seeking an immediate suspension of military aid to Israel for its actions in Gaza, emphasizing that such decisions fall within the purview of the government rather than the courts.
In response to a public interest litigation filed by a group of retired public servants, scholars, and citizens, the bench, led by Chief Justice of India Dhananjaya Y Chandrachud, ruled that Indian courts cannot assert jurisdiction over matters concerning a sovereign nation like Israel.
Additionally, the court noted that the supply of arms by Indian companies to Israel is governed by international contracts, which cannot be interfered with by judicial decisions due to firm commitments established under contractual obligations. The argument, presented by advocate Prashant Bhushan, regarding the Genocide Convention and its implications for the supply of arms to countries involved in genocide and war crimes was considered in the case.
The individual stated that Israel has engaged in the killing of civilians through the bombing of schools and hospitals. Additionally, the provision of arms by India during the conflict in Gaza would constitute a violation of the Genocide Convention.
